These Terms of Service ("Terms") constitute a legally binding agreement between you and Scrape AI ("we," "us," or "our") governing your access to and use of the website at https://getscrape.ai and the Scrape AI document data extraction platform (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. THE SERVICES

Scrape AI is a document data extraction platform that allows users to upload PDF and DOCX files, automatically extract structured data fields using AI, review and edit results in a spreadsheet-style interface, and export data as CSV or Excel files.

2. ELIGIBILITY

You must be at least 18 years old to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Services on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

3. ACCOUNTS

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: Provide accurate and complete registration information; keep your password secure and confidential; notify us immediately of any unauthorized access at chrisqha@gmail.com; not share your account with others. We reserve the right to suspend or terminate accounts that violate these Terms.

4. SUBSCRIPTIONS AND BILLING

Current availability: The Services are currently available on a free trial basis. Paid subscription plans will be introduced in the future.

Future paid plans: When paid plans are introduced: Subscriptions will be billed monthly or annually; monthly subscriptions are non-refundable; annual subscriptions may be eligible for pro-rated refunds at our discretion; we will provide advance notice of pricing before any charges apply; you may cancel at any time; cancellation takes effect at the end of the current billing period. We reserve the right to modify pricing at any time with reasonable advance notice.

5. AI-POWERED EXTRACTION — ACCURACY DISCLAIMER

IMPORTANT: Please read this section carefully.

Scrape AI uses artificial intelligence to extract data from uploaded documents. AI-powered extraction is inherently probabilistic and may produce inaccurate, incomplete, or incorrect results.

You are solely responsible for: Reviewing all extracted data before use; verifying the accuracy of extraction results against source documents; any decisions made based on extracted data; any consequences resulting from reliance on extracted data without verification.

Scrape AI makes no warranty, express or implied, regarding the accuracy, completeness, or reliability of any data extracted through the Services. We are not liable for any errors, omissions, or inaccuracies in extracted data or for any loss or damage arising from your reliance on such data. This disclaimer applies regardless of the cause of inaccuracy.

6. ACCEPTABLE USE

You agree to use the Services only for lawful purposes. You agree not to: Upload documents you do not have the right to process; upload documents containing illegal content; attempt to reverse engineer, decompile, or extract the source code of the Services; use the Services to develop a competing product; attempt to gain unauthorized access to any part of the Services; use automated scripts or bots without our written permission; transmit viruses, malware, or other harmful code; use the Services in any way that could damage, disable, or impair the Services; violate any applicable laws; upload documents containing personal information of third parties without appropriate authorization.

7. INTELLECTUAL PROPERTY

Our property: The Services, including all software, design, text, graphics, and other content created by us, are owned by Scrape AI and protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

Your property: You retain all ownership rights to documents you upload and data you export. We do not claim ownership over your content.

8. USER-UPLOADED CONTENT

By uploading documents, you represent and warrant that: You own the documents or have the legal right to upload and process them; the documents do not contain content that violates any applicable law; you have obtained any necessary consents to process personal information contained in the documents.

You grant us a limited, non-exclusive license to process your uploaded documents solely for the purpose of providing the Services. We do not use your uploaded documents to train AI models. Documents are processed through Anthropic's Claude API in accordance with Anthropic's API usage policies. We are not responsible for the content of documents you upload. You indemnify us against any claims arising from your uploaded content.

9. THIRD-PARTY SERVICES

The Services rely on third-party providers including: Anthropic (AI processing), Supabase (authentication and database), Vercel (hosting and infrastructure). Your use of the Services is subject to the terms and privacy policies of these providers. We are not responsible for the practices of third-party services.

10. DISCLAIMERS

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the Services will be uninterrupted, error-free, or secure; that any errors will be corrected; or that extraction results will be accurate or complete. Your use of the Services is at your sole risk.

11. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCRAPE AI AND ITS OWNERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100). Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

12. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Scrape AI and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your violation of these Terms, your uploaded content, or your violation of any third-party rights.

13. TERMINATION

We may suspend or terminate your access at any time, with or without cause or notice. Grounds include violation of these Terms, fraudulent activity, or conduct harmful to other users or to us. You may terminate your account at any time by contacting us at chrisqha@gmail.com. Upon termination, your right to use the Services ceases immediately. We may retain certain information as required by law or for legitimate business purposes.

14. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. Any dispute shall first be attempted to be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction. You agree that any dispute resolution will be conducted on an individual basis and not as a class action. California residents may also contact the California Department of Consumer Affairs at https://www.dca.ca.gov.

15. CHANGES TO THESE TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new effective date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
